A presente dissertação trata o problema da relevância do erro sobre o concreto âmbito de validade espacial da lei penal, incidindo sobre a jurisdição prescritiva do Estado, ou seja, sobre um concreto poder para incriminar condutas.
Para tal, começa-se por integrar as normas de validade espacial e os critérios aí inseridos na estrutura do facto punível.
Depois da inclusão dos critérios de validade espacial intrínsecos na categoria da tipicidade, desenvolve-se as consequências que isto terá para efeitos de erro.
Por um lado, em alguns casos, o facto de o agente desconhecer o critério de validade espacial poderá fundar um erro de tipo, especialmente no que concerne ao erro sobre o local de resultado. Em outras situações, suscitam-se considerações no plano da culpa, na medida em que uma valoração errónea sobre a ilicitude da norma penal de um ordenamento jurídico implicará a aceitação de um erro sobre a ilicitude.
The present dissertation deals with the issue of the relevance of mistake as regards the specific spatial scope of validity of Criminal Law, focusing on the State’s prescriptive jurisdiction, or in other words, on its specific power to criminalize conduct. To this end, one must begin by integrating the norms behind spatial validity and the relevant criteria established within the structure of the criminal offense itself. After establishing the criteria of spatial validity intrinsic to the categorization of criminal acts, we then examine the possible consequences that these may entail in respect to mistake in the aforementioned context. On the one hand, in some cases, the fact that the agent is unaware of the criteria of spatial validity involved may provide grounds for a certain type of mistake, especially as regards the mistake about the place of the result. In other situations though, it raises considerations as regards to guilt, in that an erroneous valuation as to the wrongdoing of a criminal norm in a legal order may entail acknowledgement of a mistake of law.
