| dc.description.abstract | Ao longo dos 29 anos da OMC, a organização tem passado por vários desafios incluindo a falta de consenso entre estados em relação à negociação dos Acordos a nível Multilateral. Devido a esta dificuldade, os acordos plurilaterais surgiram como alternativa flexível à obtenção de consenso, tendo conta que – apesar de abertos à participação de todos os membros - envolvem apenas um grupo de membros que concordaram em fazer parte do mesmo e oferecem uma abordagem prática para fazer avançar as negociações em questões comerciais específicas sem necessidade do consenso que carateriza as regras multilaterais da OMC. No presente trabalho examinamos no contexto histórico da OMC, a emergência e evolução dos Acordos Plurilaterais, incluindo os principais acordos deste tipo, aspetos legais e institucionais, e os resultados dos mesmos, bem como examinamos os desafios à criação destes acordos, salientando o papel dos seus oponentes e as razões que apresentam. Conclui-se que apesar de tudo, os acordos plurilaterais melhoram o quadro multilateral, aumentando assim a resiliência, a adaptabilidade e a inclusividade do sistema comercial internacional, permitindo que se responda às necessidades de todos os membros da OMC. | pt_PT |
| dc.description.abstract | Over 29 years of the WTO, the organization has experienced various challenges, including the lack of consensus between states regarding the negotiations of Multilateral Agreements. Because of this difficulty, Plurilateral Agreements have emerged as a flexible alternative to reaching consensus, since they - although open to participation by all members – only involve a group of members who have agreed to be part of it and offer a practical approach to advancing negotiations on specific trade issues without the need for consensus that characterize multilateral rules of WTO. In this paper we examine in the historical context of the WTO, the emergence and evolution of Plurilateral Agreements, including the main cases, their legal and institutional aspects, as well as their results, the challenges that the creation of these Agreements faces, highlighting the role of the opponents and their reasons. The conclusion is that, despite everything else, plurilateral agreements improve the multilateral framework, thus increasing the resilience, adaptability and inclusiveness of the international trading system, allowing that the agreements respond to the needs of all WTO members. | pt_PT |
