| dc.description.abstract | A presente pesquisa visa analisar o sempre tormentoso fenômeno da mutação constitucional, assim entendido como o processo informal de mudança de normas constitucionais, sem alteração do seu texto. Para tanto, será realizada uma digressão histórica do instituto, desde seu surgimento na Alemanha de Bismark, no século XIX, passando pelos períodos pós-primeira e segunda-guerras, até os dias atuais. Posteriormente, será analisada a atual estado da arte nas doutrinas de Brasil e Portugal, para então passarmos ao estudo da jurisprudência do Supremo Tribunal Federal sobre a matéria. Serão analisadas as decisões proferidas pela Casa, uma a uma, para que se identifiquem os argumentos utilizados por aquela Corte, prodígia em sua utilização, para depois, então, promovermos o aprofundamento desses argumentos e buscarmos responder se justificam efetivamente a ocorrência das mutações constitucionais, a partir dos parâmetros apontados pela doutrina especializada trabalhada neste texto, e nos próprios argumentos utilizados pelo Tribunal, sobretudo no que respeita aos métodos interpretativos empregados pela Corte. Ao longo do trabalho, também serão expostos gráficos que demonstram quantitativamente as ocorrências da mutação na jurisprudência da Corte, permitindo identificar a postura institucional e não somente teórica a seu respeito. Ao final, serão incluídos anexos com o tabelamento realizado, com os dados de todos aos acórdãos analisados, para futuras pesquisas de leitores interessados no aperfeiçoamento deste trabalho. | pt_PT |
| dc.description.abstract | This research aims to analyze the always tormenting phenomenon of constitutional mutation, understood as the informal process of changing constitutional norms, without altering their text. To this end, a historical tour of the institute will be carried out, from its emergence in Bismark Germany in the 19th century, through the post-First and Second World Wars periods, to the present day. Subsequently, the current state of the art in the doctrines of Brazil and Portugal will be analyzed, and then we will move on to the study of the Federal Supreme Court's jurisprudence on the matter. The decisions handed down by the House will be analyzed, one by one, to identify the arguments used by that Court, a prodigy in its use, so that we can then promote the deepening of these arguments and seek to answer whether they effectively justify the occurrence of constitutional changes, based on the parameters pointed out by the specialized doctrine worked on in this text, and in the arguments used by the Court itself, especially with regard to the interpretative methods used by the Court. Throughout the work, graphs will also be displayed that quantitatively demonstrate the occurrences of mutations in the Court's jurisprudence, allowing the identification of the institutional and not just theoretical stance regarding it. At the end, annexes will be included with the tabulation carried out, with data from all the judgments analyzed, for future research by readers interested in improving this work. | pt_PT |
