| dc.description.abstract | Com o desenvolvimento das cidades, fez-se necessária a criação de politicas publicas que ordenassem os espaços para a vida da comunidade, surgindo, assim, regras de ordenamento do território e do urbanismo. Com o surgimento do Estado Social, o 4mbito do urbanismo com funções publicas ganhou um significativo incremento a partir do entendimento da fungo social da propriedade, que limitou o poder absoluto do proprietário sobre seu bem imóvel. O direito de construir é alvo de muitos debates, sendo objeto de diversos litígios judiciais, uma vez que existe a confusão em definir se este direito é uma faculdade intrínseca ao direito de propriedade ou se este direito de construir é apenas uma permissão concedida pela administração publica | pt_PT |
