| dc.description.abstract | O direito de constituir família está previsto constitucionalmente em Portugal e no Brasil, através das normas que preveem e protegem as diversas entidades familiares. Assim, havendo um direito de constituir família e a possibilidade da união entre pessoas do mesmo sexo, torna-se importante a discussão acerca do direito de se ter filhos. Isto porque é permitida a constituição da família homoafetiva em Portugal, através de Lei, mas há a limitação para a realização do seu Projeto Parental com filhos. Portanto, discute-se a incoerência jurídica em reconhecer a família homoafetiva, mas, diante de frágeis argumentos da doutrina portuguesa, proibir a concretização da família com filhos. Faz-se, assim, o comparativo com o direito brasileiro, onde, embora não haja lei regulamentando estas uniões, verifica-se intensa produção jurisprudencial permitindo a realização do projeto parental de maneira plena e resguardando o direito fundamental dos pares homoafetivos de constituir família. | por |
| dc.description.abstract | The right of constituting a family is constitutionally provided for in Portugal and in Brazil, through rules which foresee and protect the various family entities. Therefore, as there is this right of family constitution and the possibility of union between people from the same sex, it is important to discuss about the right of having children. This is due to the permission of homoaffective family constitution in Portugal through its Laws but, at the same time, with limits to the accomplishment of its Parental Project with children. Thus, this paper discusses the juridic incoherence in recognizing the homoaffective family, but, before the fragile arguments of the Portuguese doctrine, prohibiting the achievement of family with children. It leads, thus, to a comparison with Brazilian rights in which, although there is no law regulating these unions, it can be verified an intense jurisprudential production permitting the accomplishment of the Parental Project to the fullest and also saving the Fundamental Right to the homoaffective couples of constituting a family. | eng |
