Neste trabalho tentou-se provar a constitucionalidade (ou não) da Lei nº 9.307/1996 através de buscas e incessantes leituras para, a todo custo, confirmar esta hipótese ou procurar evidências empíricas que possam derrubá-la. Não há dúvidas quanto a sua relevância, mas, também, isso não é de fácil conclusão em razão da complexidade de análise pelo País em voga. O interesse na compreensão da constitucionalidade da Arbitragem é demasiado grande. O que se quer na presente pesquisa é identificar a melhor solução para o tema mediante o enfrentamento da realidade atual e, sobretudo, do que vem sendo escrito e praticado extrajudicialmente na resolução de conflitos. Analisou-se a constitucionalidade ou não da Lei nº 9.307/96, bem como o alcance do princípio da inafastabilidade ou princípio da indeclinabilidade do controle jurisdicional. Este princípio está disposto no artigo 5º, XXXV da Constituição Federal de 1988 (CF/88), que diz que a lei não excluirá da apreciação do Poder Judiciário lesão ou ameaça a um direito. A legislação portuguesa foi citada e tentou-se levantar inconstitucionalidades. Por razões da pandemia que assolou a humanidade em 2020 já não se conseguiu fazer um apanhado muito aprofundado da evolução científica da arbitragem por dificuldades de acesso às bibliotecas. Assim também ficou prejudicado texto referente às comparações por motivo do contexto pandêmico que nos encontramos.
In this work we tried to prove the constitutionality (or not) of Law No. 9,307/1996 through searches and incessant readings to, at all costs, confirm this hypothesis or look for empirical evidence that can overturn it. There is no doubt about its relevance, but also this is not easy to conclude due to the complexity of analysis by the country in vogue. The interest in understanding the constitutionality of arbitration is too great. What is wanted in this research is to identify the best solution for the theme by confronting the current reality and, above all, of what has been written and practiced extrajudicially in conflict resolution. The constitutionality or not of Law No. 9,307/96 was analyzed, as well as the scope of the principle of intensity or principle of the indeclinability of judicial control. This principle is laid down in Article 5, XXXV of the Federal Constitution of 1988 (CF/88), which says that the law will not exclude from the judiciary's assessment injury or threat to a right. Portuguese legislation was cited, and it was tried to raise unconstitutionalities. For reasons of the pandemic that plagued humanity in 2020, a very thorough overview of the scientific evolution of arbitration due to difficulties in accessing libraries was no longer possible. Thus, text referring to the comparations due to the pandemic context we found was also impaired.
