O artigo procede a distinção entre economia de partilha e economia colaborativa centrando-se no enquadramento jurídico de plataformas colaborativas (como a Uber ou a Airbnb) a luz do Direito da União Europeia. A este propósito, é analisada jurisprudência do Tribunal de Justiça da Unido Europeia e a posição da Comissão Europeia, concluindo-se pela falta de harmonização do regime jurídico aplicável a algumas plataformas colaborativas na Unido Europeia, encontrando-se essa tarefa atualmente cometida aos Estados-Membros que têm seguido caminhos diversos no que se refere a regulação especifica
The paper distinguishes between sharing economy and collaborative economy focusing on the legal framework of collaborative platforms (such as Uber or Airbnb) according to EU law. Case law from the Court of Justice of the European Union and the position of the European Commission are analyzed in this regard, and it is concluded that there is no harmonization in the European Union of the legal regime applicable to certain collaborative platforms. As so, the specific regulation of collaborative platforms has followed different paths within the member states
