O objetivo do estudo é identificar e analisar os principais temas em discussão no STF relativamente ao direito à saúde no contexto do combate à pandemia da covid-19. A síntese das principais discussões aponta para um reforço da dimensão transindividual do direito à saúde, sem deixar de assegurar situações individuais. Também é perceptível o esforço por assegurar tanto a prerrogativa da união de estabelecer critérios gerais e assumir a coordenação geral no que diz com as políticas e medidas em geral de combate à pandemia, quanto garantir que estados e municípios não fiquem imobilizados. A maior deferência a critérios científicos, evidências e estatísticas aparece como uma tendência. Também há um incremento de ações do tipo estruturante, indicando um caminho viável para o diálogo institucional e para o equilíbrio entre os poderes. Por último, evidencia-se uma tendência de fortalecimento da proteção de grupos vulneráveis
The purpose of the study is to identify and analyze the main issues under discussion in the brazilian supreme court regarding the right to health in the context of fighting the covid-19 pandemic. The synthesis of the main discussions reveals a strengthening of the transindividual dimension of the right to health, without ceasing to ensure individual situations. The effort to ensure the prerogative of the Federal Government to establish general criteria and assume general coordination with regard to policies and measures in general to fight the pandemic is also perceptible, as well as to guarantee that states and municipalities are not restrained. the greater deference to sci- entific criteria, evidence and statistics appears as a trend. There is also an increase in structuring-type actions, indicating a viable path for institutional dialogue and for the balance between the powers. Finally, a trend toward strengthening the protection of vulnerable groups is evident.
