O aumento da litigância no domínio da responsabilidade civil médica tem deixado transparecer uma larga margem de insucesso na efectivação da responsabilidade civil pelos danos decorrentes da prática de actos médicos. Nestes casos, as regras relativas ao ónus da prova deixam de ser meras regras de distribuição do encargo probatório e de repartição do risco de insuficiência probatória pelas partes, convertendo-se num factor que, a priori e sistematicamente, determina o insucesso de uma delas (o paciente) em favor da outra (o médico). De modo a corrigir esta situação, vieram a ser desenvolvidos, em vários ordenamentos jurídicos, mecanismos que permitem flexibilizar e facilitar, a favor do paciente lesado, o encargo probatório que
sobre ele recai.
O presente estudo centra-se, portanto, na problemática relativa à distribuição do
ónus da prova nas acções de responsabilidade civil médica, assumindo como objectivo
principal aferir do tratamento concedido a esta questão pela jurisprudência portuguesa,
mais especificamente, apurar quais as soluções que vêm sendo adoptadas pela mesma
no sentido da salvaguarda da posição processual do paciente lesado.
The increase of litigation in the area of civil medical liability has revealed a wide margin of failure in enforcing civil liability for medical malpractice. In these cases, the rules governing the burden of proof no longer are mere rules of distributing the burden of proof and the risk of lack of proof by the litigants. Those rules become a mechanism of systematic pre-determination of failure of one of the litigants (the patient), benefiting the other (the doctor). In order to amend this situation, in several legal systems, doctrine and jurisprudence came to develop methods of easing the burden of proof, which rests upon the offended patient. Therefore, the present study focuses upon the burden of proof distribution in civil medical liability lawsuits, taking as its main objective to assess the current approach granted this issue by Portuguese jurisprudence, more specifically, to ascertain the solutions that are being adopted by Portuguese courts towards safeguarding the position of the offended patient.
