Resumo(s)
O presente trabalho tem por escopo a delimitação do conceito da transmissão de
estabelecimento no Direito do Trabalho, tratando, por isso, do desenvolvimento que este conceito teve e dos desafios que lhe são colocados perante o mundo actual.
A transmissão de estabelecimento, enquanto vicissitude contratual, é objecto de
um regime próprio, pelo que é realizada uma análise crítica do seu regime jurídico, numa
perspectiva nacional, europeia e em sistemas de referência, sendo atribuído especial
relevo a alguns assuntos que, quer doutrinariamente, quer jurisprudencialmente, são controversos.
Por fim, partindo do conceito de transmissão de estabelecimento delimitado e dos
aspectos do seu regime, é apreciada a respectiva natureza jurídica e expostas as
conclusões.
This thesis aims to define the concept of transfer of undertaking or business in labour law, therefore approaching this concept’s evolution and its challenges given the present environment. The transfer of undertaking or business, as a contractual vicissitude, is subject to its own regime. As such, it requires a critical analysis of its legal framework, on a national and European basis as well as reference systems, and special attention is given to some controversial subjects, both doctrinally and jurisprudentially. Finally, considering the concept of transfer of undertaking or business established and the features of its regime, this thesis evaluates its legal nature and presents the main conclusions.
