A Uber, o motorista e o cliente : três ou quatro? : a propósito de uma decisão do Supreme Court do Reino Unido

| dc.description.abstract | Neste artigo é analisada uma recente e importante decisão do Supremo Tribunal britânico sobre o estatuto jurídico dos motoristas que prestam serviços à Uber, procurando os autores refletir sobre o conteúdo dessa decisão e sobre a forma como, em Portugal, esta questão foi tratada na chamada “Lei Uber” (Lei n.º 45/2018, de 10 de agosto). Conclui-se com um juízo muito reticente quanto à bondade da nossa lei, que parece ter transformado artificialmente aquilo que seria uma relação a três (entre a Uber, o motorista e o cliente) numa relação a quatro, através da criação da figura do “operador de TVDE”, quiçá com o objetivo e decerto com o efeito de inviabilizar o reconhecimento da existência de um genuíno contrato de trabalho entre a Uber (ou as empresas congéneres) e os seus motoristas. | pt_PT |
| dc.description.abstract | This article analyzes a recent and important decision of the British Supreme Court on the legal status of drivers who provide services for Uber. The authors seek to reflect on the content of this decision and on the way in which, in Portugal, this issue was addressed in the so-called “Uber Law” (Law No. 45/2018, of 10 August). It concludes with a very reticent judgment about the virtue of our law, which seems to have artificially transformed what would be a three-way relationship (between Uber, the driver and the customer) into a four-person relationship, through the creation of the so-called “TVDE operator”, perhaps with the objective and certainly with the effect of making it impossible to recognize the existence of a genuine employment contract between Uber (or similar companies) and its drivers. | pt_PT |
