Judaísmo e judeus na legislação portuguesa: da medievalidade à contemporaneidade

Tem este trabalho como objectivo a análise das repercussões ocorridas no seio das
comunidades judaicas e no do judaísmo, com a entrada em vigor da legislação portuguesa
de carácter religioso que, em nosso entender, maior influência exerceu.
Dividimos as matérias abordadas em cinco capítulos: “Os judeus na cristandade
portuguesa”, “A construção do estado confessional”, “A revolução liberal de 1820, a
liberdade religiosa e a confessionalidade do Estado”, “A separação do Estado das Igrejas”
e “As sinagogas”.
Começamos por uma introdução e pelos antecedentes históricos desde a chegada
dos judeus à Península Ibérica até à publicação das Ordenações Afonsinas.
A abordagem, de forma cronológica, aos diversos diplomas legislativos, é iniciada
com aquelas Ordenações; seguem-se-lhes o Édito de expulsão de D. Manuel I e a
Inquisição, as leis do Marquês de Pombal, as três constituições da monarquia liberal e os
códigos penais que lhes estiveram subjacentes, uma síntese do constitucionalismo
moderno, a Lei da Separação do Estado das Igrejas de 11 de Abril de 1911, as
Constituições de 1911 e 1933, a Concordata com a Santa Sé de 1940, a Constituição de
1976, o Código Penal de 1982, a Lei da Liberdade Religiosa e três convenções
internacionais ratificadas por Portugal.
Concluímos o texto principal com uma alusão às sinagogas, fundamentalmente as
portuguesas, e, a final, expomos as conclusões.
Anexamos dezassete documentos, que compreendem, para além dos diplomas
legislativos referidos, uma cronologia de legislação portuguesa, os estatutos da
Comunidade Israelita de Lisboa e o alvará de aprovação destes estatutos.
Das fontes constam as bibliotecas e arquivos consultados, as fontes informáticas
(internet) e a bibliografia.
ABSTRACT: The aim of this work is to analyze the repercussions that occurred within the jewish communities and within judaism itself, through the enforcement of the portuguese legislation which, in our opinion, had a major influence. We divide the subjects covered in five chapters: "The jews in portuguese christendom", "The construction of the confessional state", "The liberal revolution of 1820, the religious liberty and the confessionality of the State", "The separation of the state from churches” and "the synagogues". We start with an introduction and a historical background of judaism from their arrival at the Iberian Peninsula, until the publication of the “Ordenações Afonsinas”. The chronological approach to the various legislative documents starts with these “Ordenações”; followed by the Edict from D. Manuel I and the Inquisition, the laws of Marquês de Pombal, the three constitutions of liberal monarchy and the criminal codes behind, a synthesis of modern constitutionalism, the Separation Law of the State of the Churches of April 11, 1911, the Constitutions of 1911 and 1933, the Concordat with the Holy See, 1940, the Constitution of 1976, the Penal Code of 1982, the Law of Religious Liberty and three international conventions ratified by Portugal. We conclude the main text with an approach to the synagogues, mainly the portuguese ones, and finally we present the conclusions. Attached are seventeen documents that include, apart from the majority of the legislative diplomas referred above, a chronology of portuguese law, the statutes of CIL and the license approving these statutes. The sources listed consist of libraries and archives consulted, informatics sources (internet) and bibliography.
