O presente estudo analisa o tema da má fé na impugnação pauliana, esclarecendo o respetivo sentido e limites, buscando clarificar também a figura da negligencia consciente e inconsciente do adquirente e do devedor nos atos de disposição patrimonial onerosos. Trata-se de uma investigação onde apresentamos um tratamento dogmático dos principais problemas da má fé, tal como consagrada no Código Civil, percorrendo vários aspetos da figura desde o direito romano. Ensaiamos ainda uma construção sobre a medida de esforço das partes para informarem-se sobre o prejuízo à garantia patrimonial do credor, numa compreensão integrada de várias figuras legais.
Ensaiamos uma construção destinada a atenuar o problema da prova da má fé na impugnação pauliana, consoante um dever de conhecimento das partes no que respeita aos atos de disposição patrimonial onerosos. Isto tudo é aclarado à luz da boa fé subjetiva ética. Partindo de situações práticas, analisam-se traços que podem elevar ou não a medida de esforço para conhecimento da lesão ou prejuízo da garantia patrimonial, bem como suas virtualidades, buscando um quadro em que a prova da má fé na impugnação
pauliana não se afigure tão penoso para o credor.
This dissertation aims to analyze the theme of bad faith in the revocatory act, clarifying the respective meaning and limits, seeking to clarify also the figure of the conscious and unconscious negligence of the acquirer and the debtor, in acts of costly disposition of property. It is an investigation where we present a dogmatic treatment of the main problems of bad faith, as enshrined in the Civil Code, covering several aspects since Roman law. We also experimented a construction on the measure of effort of the parties to inquire about the damage to the creditor's equity guarantee in an integrated understanding of several legal figures. Thus, we rehearsed a construction designed to alleviate the problem of proof of bad faith in the Pauline challenge, according to a duty of knowledge of the parties with regard to the provisions of onerous property. This is all clarified in the light of good ethical subjective faith. Starting from practical situations, we analyze traits that may or may not raise the measure of effort to knowledge of the injury or loss of the asset guarantee, as well as its potentialities, seeking a framework in which the proof of bad faith in the revocatory act does not appear as difficult for the creditor.
