É impreterível dispor uma solução para os problemas que têm surgido, nomeadamente, na relação do princípio da não auto incriminação com o desbloqueio dos smartphones biometricamente. Neste sentido, enquanto não houver atualização da legislação, cada caso tem que ser analisado individualmente, com recurso ao princípio da proporcionalidade, isto é, este princípio será sempre o melhor critério para a resolução de problemas aos quais a legislação ainda não está apta a solucionar. Trata-se assim de um princípio essencial onde são ponderados e analisados os direitos e bens jurídicos em causa.
It is imperative to find a solution to the problems that have arisen, namely in relation to the principle of non-self-incrimination with the unblocking of smartphones biometrically. In this sense, as long as there is no update of the legislation, each case has to be analysed individually, with refusal to the principle of proportionality. this principle will always be the best criterion for solving problems that the legislation is not yet able to solve. This is an essential principle in which the legal rights and property in question are weighed and analyzed.
