| dc.description.abstract | O sistema jurídico internacional é rico em instrumentos legais sobre os direitos da criança, notoriamente através da Convenção sobre os Direitos da Criança. Contudo as crianças de rua continuam a não conseguir exercer plenamente os seus direitos. A fiscalização de como a Convenção sobre os Direitos da Criança está a ser implementada tem-se feito maioritariamente através da apresentação de relatórios periódicos ao Comité dos Direitos da Criança. O Comité tem usado este sistema criativamente na proteção de crianças de rua, mas não dispõe de meios de responsabilização dos Estados não cumpridores. Mecanismos de queixa, como os previstos no novo Protocolo Facultativo sobre Procedimentos de Comunicação ou os tribunais poderão também dar proteção aos direitos das crianças de rua e definir a posição de direito no seu caso concreto, mas o acesso a estes por crianças de rua é difícil e a execução de qualquer decisão dependerá também ela da vontade do Estado em causa em a acatar. Dada a complexidade das causas e situação das crianças de rua e das fraquezas do sistema jurídico internacional na proteção dos seus direitos, esta terá necessariamente que passar pelo recurso concertado aos meios acima indicados. A proteção dos direitos de crianças de rua passa também por uma abordagem multidisciplinar e não meramente jurídica, mas que exige necessariamente Estados de Direito fortes capazes de assegurar a proteção dos direitos desta categoria de crianças. | pt_PT |
| dc.description.abstract | The international legal framework comprises a wealth of legal instruments on the rights of the child, noticeably, through the Convention on the Rights of the Child. However, street children remain unable to fully exercise their rights. The monitoring of how the Convention on the Rights of the Child is being implemented has mainly been undertaken through periodic reports to the Committee on the Rights of the Child. The Committee has been using this system creatively in the protection of street children. However, this system does not have ways of making non-compliant States accountable. Complaint mechanisms, such as those included in the Optional Protocol to the Convention on the Rights of the Child on a Communications Procedure or the judiciary, may also protect the rights of street children and set points of law in each case, but access to them by street children is difficult and enforcing any decision will depend on the will of the State to follow it. Given the complexity of the causes and situation of street children and the weakness of the international legal system in protecting their rights, protection will require a multidisciplinary approach and not only a legal approach. In any case, it will demand States strongly grounded on the Rule of Law with the ability to secure protection to the rights of this group of children. | en |
