A presente dissertação trata do dano ecológico e de garantias financeiras destinadas ao seu ressarcimento. Nesta investigação, procuramos estudar o que é, como se imputa e como se garante a indemnização do dano ecológico. Atualmente, o dano ecológico bem como o direito ambiental obrigam a uma alteração dos paradigmas dos institutos clássicos do direito civil e uma adaptação da atuação da Administração Pública, designadamente, na prevenção do dano ecológico. Tendo como referencial o princípio da prevenção e o princípio do poluidor-pagador, analisamos as garantias financeiras e alguns dos problemas e recomendações de doutrina estrangeira. Da investigação que realizamos, procuramos conhecer o maior número de soluções para, depois de uma análise crítica, efetuar considerações político-legislativas com o propósito de serem ou não seguidas pelo legislador nacional, designadamente, no que concerne ao DL 147/2008.
The present dissertation deals with the ecological damage and financial guarantees, which are set specifically to reimburse it. In this investigation, we seek to study what it is, how it is imputed and how to guarantee compensation for ecological damage. Nowadays, ecological damage as well as environmental law require a change in the paradigms of the classic institutes of civil law and an adaptation of the actuation of the Public Administration, namely, in the prevention of ecological damage. Based on the principle of prevention and the principle of the polluter pays, we analyze the financial guarantees and some of the problems and recommendations of foreign doctrine. From our research, we seek to know a greatest number of solutions, which, after a critical analysis, we could make some policy considerations with the purpose of being followed by the national legislator, namely, regarding with the scope of DL 147/2008.
