Abstract(s)
A presente dissertação tem o intuito de proceder a uma análise dos critérios judiciais de suspensão da execução da pena de prisão nos crimes contra a liberdade sexual de adultos, dissecando a existência atual de preconceitos, mitos e estereótipos e de que forma estes podem influenciar a motivação do Tribunal para suspender a pena de prisão dos agressores sexuais.
Esta dissertação serviu também para fazer uma análise do instituto da suspensão da pena de prisão, bem como ao fenómeno da violência sexual.
Ao longo desta dissertação pretende demonstrar-se que, apesar de todas as alterações legislativas que ocorreram ao longo dos tempos, no âmbito dos crimes sexuais ainda não se alcançou a evolução desejada.
O objetivo central do presente estudo será, assim, refletir sobre a forma como os preconceitos, mitos e estereótipos associados à violência sexual estão ainda presentes não só na sociedade, como no sistema judicial, desconstruir os mesmos, e fazer uma análise dos critérios que levam o Tribunal a decretar a suspensão da pena de prisão efetiva.
Os resultados deste estudo permitiram concluir que a existência de mitos e estereótipos social e culturalmente enraizados, aos quais o julgador não é imune, influenciam a convicção do Tribunal em suspender a pena de prisão de determinados agressores sexuais.
The present thesis aims to analyze the judicial criteria of suspended execution of prison sentence in crimes against adults’ sexual freedom, dissecting the prejudices, myths and stereotypes that currently exist, and how they can influence the Court’s motivation to suspend the prison sentence of sexual offenders. Additionally, this dissertation enabled both the analysis of the application of suspended execution of sentence, and the sexual violence phenomenon. Throughout this thesis it is intended to demonstrate that, despite all the legislative alterations that have been occurring, the desired evolution has not been achieved in the scope of sexual crimes. The main goal of this work will, therefore, be to reflect upon the way in which sexual violence related prejudices, myths and stereotypes are still present not only in society but also in the judicial system and the respective deconstruction. Moreover, it targets an analysis on the criteria that leads the Court to decree the suspended execution of effective prison sentence. The results of this study allow the conclusion that the existence of myths and stereotypes socially and culturally rooted, to which one is not immune, influence the conviction with which the Court suspends the execution of prison sentence of certain specific sexual offenders.
