| dc.description.abstract | O trabalho aborda os pontos mais importantes referentes à matéria enfocada, tais como: a hipoteca e seu enquadramento jurídico; estuda o instituto como direito real; traça uma distinção entre direitos reais e pessoais; aborda essas distinções; estuda os conceitos legais e doutrinários da hipoteca; perfila sua evolução histórica; estuda-a no direito civil brasileiro, bem como no português; faz abordagem do instituto como negócio jurídico que é; menciona seus fatores de eficácia; aborda a necessidade de registro como elemento essencial à sua validade erga omnes, como destaque para o direito português como condição sine qua non de eficácia até mesmo entre as partes celebrantes. | por |
| dc.description.abstract | The present study has the objective to list the most important issues to the subject focused, such as: The mortgage and juridical framework; study the institution as user rights; delineate the difference between personal and property law; approach these differences; study the mortgage doctrinal and their legal concepts; profiling their evolution through time; study their concepts in the brazilian and the portuguese Civil Rights; approach the concept of the institute as a juristic act; mention their efectiveness factor; approach the requirements records as essential element to the erga omnes agreement, highlighting the fundamental importance of the Portuguese Law to the effectiveness beetween the involved parties. | en |
