O presente trabalho tem a finalidade de verificar a responsabilidade civil do médico, sobretudo nas hipóteses de erro de diagnóstico. Para tanto, analisa-se o conceito de responsabilidade civil, bem como a evolução da responsabilidade civil do médico, até se chegar ao conceito atual de ato médico, observando-se seus pressupostos. Na legislação brasileira, o Código de Defesa do Consumidor, cuja base é a responsabilidade objetiva, inclui a responsabilidade civil do médico como profissional liberal. No entanto, trata-o como exceção, adotando o conceito de culpa, no caso de responsabilização do médico. Esse destaque torna desnecessária a inserção dos profissionais da saúde no CDC. Para caracterizar a responsabilidade civil do médico, o erro de diagnóstico deve ser inescusável, exigindo-se, além disso, a verificação do nexo de causalidade, a ação ou omissão e o dano causado. O erro de diagnóstico pode ocorrer no âmbito do consentimento informado, quando o paciente toma uma decisão baseada em informações equivocadas dadas pelo médico. Dessa forma, mesmo tendo externado sua vontade, de forma livre e consciente, o fez com base em erro. O erro de diagnóstico resultante na perda de uma chance deve ser visto como dano autônomo. Por esse motivo, o cálculo da indenização respectiva será feito com base em critérios probabilísticos, levando-se em consideração a chance de resultado exitoso que teria o paciente.
The present study is intended to verify the liability of the physician especially in cases of misdiagnosis. It analyzes the concept of civil liability and the development of civil responsibility of the doctor, until reaching the current concept of medical procedure, observing their assumptions. In the Brazilian legislation, the Consumer Protection Code, whose base is the strict liability, including the liability of the doctor as a professional person. Nonetheless, treat it as an exception, adopting the any concept of fault in the case of medical responsibility, a fact that makes unnecessary the inclusion of health professionals at CDC (Consumer Code). To characterize the civil responsibility of the doctor, wrong diagnoses should be inexcusable, demanding, in addition, the verification of causation action or inaction and the damage. Misdiagnosis may occur within the informed consent where the patient takes a decision based on misinformation given by the physician. Thus, despite having voiced their will freely and consciously made based on error. The resulting error diagnosis in the loss of a chance should be seen as self-injury. For this reason, the calculation of the respective damages shall be based on probabilistic criteria, taking into consideration the likely of successful outcome which would have the patient.
