Até a independência do Brasil a pena de prisão ainda não havia se institucionalizado como sanção penal. Embora, já nos séculos XVII e XVIII houvesse na Europa movimentos para implementar a pena de prisão, no Brasil, apenas no século XIX foi que a prisão passou a ser tratada como a principal forma de punição. Depois da independência de Portugal, ainda durante o Império, surgiram vários regulamentos penitenciários, o mesmo ocorrendo no período republicano da história brasileira, culminando, em 1984, com a edição da Lei de Execução Penal – LEP (Lei 7.210/84).
Nada obstante as inúmeras disposições da LEP no sentido de humanizar o castigo penal, verificou-se, na prática, que isto não ocorreu. Os presos são tratados em condições sub-humanas, em franco desrespeito às disposições legais e constitucionais, bem como aos preceitos estabelecidos em âmbito internacional, pela
ONU. No entanto, está em funcionamento no Brasil um método de execução penal conhecido por método APAC, que garante a dignidade do preso e tem alcançado excelentes resultados na recuperação e reabilitação do preso. Tal método se funda em doze elementos essenciais e, a partir deste núcleo fundamental que se estabelece a espinha dorsal do método APAC, de modo que todas as ações são
desenvolvidas para que tais elementos se concretizem. Os idealizadores do método acreditam que a implantação deste núcleo fundamental torna possível a ressocialização do preso e, de fato, a experiência tem demonstrado isso.
Until Brazil Independence, sentence prison had not been institutionalized as penal punishment. Although in Europe, between 17th and 18th centuries, some movements had already begun to implement penal punishment, in Brazil, only in the 19th century it became to be considered as a primary form of punishment. After Brazil’s Independence, but still within empire, several penitentiary regulations arose, the same occurring in the republican period of brazilian history, culminating with the edition of the Penal Execution Law in 1984 – LEP (Law 7.201/84). Notwithstanding so many provisions of LEP, in order to humanize penal punishment, in practice, they have not been applying. Prisoners have been treating in sub-human conditions, in flagrant disrespect for legal provisions, also include non-compliance with constitutional provisions as well as rules established by ONU in the international sphere. However, in Brazil has been operational one method of penal execution known as APAC, which guarantees the dignity of the prisoner and it has been achieving excellent results in terms of recuperation and rehabilitation. This method is based on twelve essential elements which are the backbone of the APAC’s method, so that all actions are developed in order to those elements could be met. Its creators are confident that the implementation of those fundamental elements makes prisioner’s resocialization possible, and, in fact, the experience has demonstrated that.
