A área da contratação pública, tal como os contratos públicos, revelam um impacto significativo nas economias e fazem parte dos pilares da gestão pública. Com o aparecimento, no final da década de 70, da Nova Gestão Pública, procurou-se modernizar a Administração Pública e aumentar os níveis de eficiência e eficácia no setor público. O governo eletrónico ganha importância e, consequentemente, traz consigo a introdução da public e-procurement ou contratação pública eletrónica. Em Portugal, no ano de 2008, é criado o Código dos Contratos Públicos, que rege a contratação pública e permitiu a criação de uma plataforma eletrónica de contratação pública, cuja gestão é assegurada pelo IMPIC, o portal BASE.
Em 2020, com o aparecimento da pandemia de SARS-CoV-2 declarada pela Organização Mundial de Saúde, verificou-se uma emergência mundial em fazer face às consequentes necessidades de aquisições no setor público provocadas pela pandemia. Portugal não foi exceção e foram implementadas pelo governo português políticas públicas na tentativa de responder às necessidades iminentes e atenuar possíveis consequências resultantes da pandemia, nomeadamente a aprovação do Decreto-Lei nº. 10-A/2020.
À luz da Teoria do Equilíbrio Pontuado, esta dissertação teve como objetivo analisar os impactos consequentes da pandemia em sete centros hospitalares de Portugal, observando-se assim a possível ocorrência de um momento de pontuação na contratação pública. Concluímos que existiu impactos tanto a nível financeiro como a nível dos procedimentos usados na contratação pública.
The area of public procurement, like public contracts, has a significant impact on economies and is one of the pillars of public management. With the emergence of the new public management at the end of the 1970s, the aim was to modernize and increase the levels of efficiency and effectiveness in the public sector. E-government was introduced, which consequently brought with it the issue of public e-procurement (electronic public procurement). In Portugal, in 2008, the Public Procurement Code was created, which allowed the creation of an electronic public procurement platform, called the BASE portal, with IMPIC in charge of its management. Given this importance of public procurement, in 2020 with the SARS-CoV-2 pandemic declared by the World Health Organization, there was a worldwide emergency to meet the consequent needs caused by the pandemic. Portugal was no exception and public policies were implemented by the Portuguese government in attempt to respond to the needs and mitigate possible consequences resulting from this pandemic. The main measures were created through Decree-Law no. 10-A/2020, bringing with them possible impacts. The theory of punctuated equilibrium is incorporated in this study, with a view to arresting changes or finding break-even points in financial terms. This dissertation aimed to analyze the impacts resulting from the pandemic in seven hospital centers in Portugal, verifying the existence of impacts both financially and in terms of the procedures used in public procurement.
