Originalmente cunhado por ativistas latino-americanos, o conceito de violência obstétrica tem ganho espaço na opinião pública portuguesa, enquanto realidade que assombra muitos partos. Desta forma, na presente dissertação procuramos elucidar o leitor acerca desta forma de violência que é exercida contra as mulheres, dando ainda conta do estado da arte em Portugal, na União Europeia e na América Latina. Posteriormente, o nosso objetivo primordial passa por averiguar de que forma o Direito Penal português, com os tipos legais existentes, pode tutelar as diversas formas de violência obstétrica. Só efetuada esta análise, nos encontraremos em posição de aferir se as vítimas de violência obstétrica, em Portugal, dispõem de uma tutela adequada para fazerem valer os seus direitos ou se, pelo contrário, a tutela é insuficiente, justificando-se, por isso, a criação de um tipo penal autónomo, como aliás, já foi proposto em Portugal.
Originally coined by Latin American activists, the concept of obstetric violence has gained ground in Portuguese public opinion as a reality that haunts many births. Therefore, in this dissertation we aim to enlighten the reader about this form of violence against women, as well as giving an account of the state of the art in Portugal, the European Union and Latin America. Subsequently, our main objective is to find out how Portuguese criminal law, with its existing legal types, can protect the various forms of obstetric violence. Only once this analysis has been carried out will we be able to assess whether the victims of obstetric violence in Portugal have adequate protection to enforce their rights or whether, on the contrary, the protection is insufficient, justifying the creation of an autonomous criminal type, as has already been proposed in Portugal.
