| dc.description.abstract | Na justiça internacional muitos são os temas controversos e discutidos pela doutrina, no âmbito dos quais ainda não foi possível chegar a um consenso alargado. Os conflitos jurisdicionais, entre instâncias internacionais, são uma dessas temáticas. A isto, acresce o facto de estarmos perante um problema relativamente novo, para o direito internacional, uma vez que esta questão ganhou uma nova forma e importância com a crescente proliferação de instâncias internacionais a que assistimos desde 1980. Esta evolução histórica dos tribunais internacionais trouxe novos problemas, com os quais a doutrina se tem ocupado nas últimas décadas. A discussão gerada à volta dos conflitos jurisdicionais internacionais, e das possíveis resoluções para os mesmos, tem ganho novos contornos ao longo das últimas décadas, e embora seja um tema relativamente recente, torna-se de suma importância se analisado ao nível dos perigos que levanta, dando especial relevo à fragmentação do direito internacional, potenciada pelo fenómeno de forum shopping. Assim, os objetivos do estudo desta Dissertação são, precisamente, um enquadramento histórico da questão; uma especial atenção dada aos sistemas de justiça internacional existentes; a apresentação dos diversos case studies onde este problema surgiu e foi abordado; uma análise das diversas teses apresentadas pela doutrina para a resolução desta temática e uma tomada de posição relativa aquela que será (na nossa opinião) a solução que melhor se apresenta para resolver este problema. É neste espírito que se torna importante uma reflexão da temática; e uma discussão alargada na comunidade internacional, com vista à obtenção de uma solução consensual e universal para este problema. Nesse âmbito, não existindo uma solução final aplicável, esta Dissertação propõe-se a ilustrar o problema e tentar esclarecer o atual ponto que esta situação encontra no direito internacional público. | pt_PT |
| dc.description.abstract | In the field of international justice there are a lot of controversial and discussed themes, for which none widespread consensus has been reached yet. The concurrent jurisdiction of international tribunals is one of those themes. In addition, there is the fact that this is a relatively new issue which has, over the past decades, increased in institutional importance with the proliferation of international tribunals since 1980. This historic evolution of international foruns brought new problems, with which the doctrine has been more and more occupied in the recent years. This discussion, around jurisdictional conflicts, and possible solutions to the problem, has gained new contexts, and is, up today, of the outmost importance the analyses of the dangers brought by this proliferation, in special the various risks created by forum shopping, namely the fragmentation of international law, enhanced by this phenomenon. Thus, the main goals of this Thesis are, precisely, the historical framework of this issue; a special attention given to the existing international justice systems; the layout of different case studies where this questions have been addressed; an analysis of the different doctrine thesis presented to the solution of this problem and a clear position on what is (in our opinion) the solution best fitted to solve this matter. It is in this spirit that a reflection on the subject becomes important; and a broad discussion in the international community, with the goal to reach a consensual and universal solution to this problem. In this context, in the absence of an applicable final solution, this thesis proposes to illustrate the problem and try to clarify the current point of the situation in international public law. | pt_PT |
