O presente estudo versa sobre a resposta dada pela Unido Europeia e pelos Estados-Membros aos desafios colocados pela crise financeira que assola a região desde 2008, concretamente no que toca aos problemas do sector bancário e a resolução de bancos em dificuldades. Será enquadrada nesse contexto a construção europeia de um Mecanismo Único de Resolução, o qual será confrontado com os dados práticos resultantes da intervenção levada a cabo pelas autoridades portuguesas no cenário de resolução do Banco Espirito Santo. Subjacente a tal analise encontra-se o propósito de identificar os princípios e regras contidos nas novas normas europeias de resolução bancaria, o seu reflexo pratico nas medidas aplicadas pelas autoridades portuguesas, bem como os desafios que se colocam perante tais soluções
his study deals with the answer given by the European Union and the Member-States to the challenges posed by the financial crisis that is affecting the region since 2008, specifically with regard to the banking problems and the resolution of banks in distress. This paper will analyze the European construction of a Single Resolution Mechanism, which will be confronted with the practical evidence retrieved from the intervention carried out by the Portuguese authorities in the resolution of Banco Espirito Santo. Underlying this analysis is the purpose of identifying the principles and rules contained in the new European regime for banking resolution, its practical application carried out by the Portuguese authorities, as well as the challenges that emerge before them
