O presente trabalho tem como objectivo analisar a problemática subjacente à Mutilação Genital Feminina, ablação dos órgãos genitais femininos por motivos culturais, e o seu tratamento no regime jurídico-penal Português.
Optamos por iniciar com uma abordagem aos crimes culturalmente motivados, de modo a apresentar um primeiro enquadramento da MGF no panorama mais geral e abstracto dos conflitos culturais.
Seguidamente, procedemos a uma contextualização da prática da MGF, através da apresentação da sua definição, tipologias, factores explicativos e sequelas.
Analisamos, ainda, o papel e a influência que a cultura exerce na construção da identidade pessoal dos indivíduos.
Por fim, a última parte do presente trabalho é dedicada à análise do tratamento jurídico que o Direito Penal reserva à MGF.
The aim of this study was to analyse and underlying the Female Genital Mutilation problematic. To look at the cultural factors motivating the removal of the female genital organs and the evolution of this topic into the Portuguese legal system. Firstly, we start with an approach to the culturally motivated crimes, in order to present a first embodiment of the FGM as a general and abstract overview of the cultural conflicts. Secondly, we contextualize the FGM practice, through presenting its definitions types, explanatory factors, and aftereffects for the victim impacted. We also analysed the role and the influence of the culture on building up the identity of individuals. Finally, the last part of this paper is devoted to analyse the legal process that Criminal Law reserves to FGM. Key
