O meio ambiente e os recursos naturais sempre careceram de um tratamento eficiente por parte do Direito e da Economia.
O presente estudo tem como objetivo analisar o impacto do modelo circular na questão da finitude de recursos, partindo do pressuposto de que a sustentabilidade é um motor para inovação na economia.
Os recursos embora sejam limitados, logo, escassos, não possibilitam uma exclusão dos agentes do seu consumo, apesar dos mesmos disputarem pela sua titularidade, o que origina uma tendência para a sobre exploração dos mesmos.
Assim, irei debruçar-me sumariamente sobre alguns pontos relacionados com o consumo, uso e apropriação de recursos, a perspetiva ecológica de circularidade dos mesmos, resíduos, e o papel do Direito enquanto Instituto Regulador.
A questão ambiental é uma questão económica. A origem do problema ambiental assenta em insuficiências do sistema de mercado que é necessário corrigir, e essa correção reguladora por parte do Direito é essencial, seja numa perspetiva económica, seja numa perspetiva fiscal.
The environment and natural resources always lacked an efficient treatment from the law and the economy. This study has as objective to analyze the impact of the circular model on the finitude of resources, assuming that sustainability is a motor for innovation in the economy. Although resources are limited, instantly, scarce, it does not make possible an exclusion of its consumption agents, despite they dispute for its ownership, that causes a tendency to over exploration of those resources. Therefore, will be discussed summarily some points related to the consumption, use and appropriation of resources, ecological perspective of circularity, waste and the role of the Law as a Regulatory Institute. The environmental issue is an economic issue. The origin of the environmental problem lays on the insufficiency of the market system which needs to be corrected, and this regulatory correction as part of the law is essential whether in an economical perspective or in a fiscal perspective.
