As tecnologias digitais foram responsáveis por profundas metamorfoses em nossas atividades laborais e interações sociais. As máquinas conectadas em rede nos permitiram aceder a conteúdos produzidos nos mais distantes pontos do planeta, e estreitar os laços de conhecimento com diferentes culturas e povos.
A desmaterialização e reprodução com alto teor de fidelidade de bens culturais alterou nossos hábitos de consumo. A gradual eliminação dos suportes materiais e a praticidade dos arquivos digitais fez-nos consumir cultura em quantidades e formatos jamais antes imaginados.
O advento do digital pôs em xeque os tradicionais papeis de artistas e indústrias, e levou-nos por um caminho sem alternativa: a necessidade de acompanhar as transformações que se sucederam e de adaptarmo-nos a elas. No combate a práticas como a pirataria, as legislações de muitos países foram endurecidas, e os meios jurídicos que versam sobre o tema enveredaram por caminhos radicais.
O presente estudo traz essa problemática à discussão, tomando como objetos de análise os contextos brasileiro e português. Discutimos as legislações que versam sobre os direitos autorais em ambos os países, para assim nos concentrarmos nas relações entre tecnologia e Direito, bem como nas metamorfoses produzidas pela Internet nessas ligações desde sempre delicadas. Para tal, tratamos também da questão da regulação da Rede, tema intimamente ligado às matérias anteriormente citadas.
ABSTRACT: The digital technologies were responsible for profound transformations in our work activities and social interactions. The network connected machines allowed us to gain access to contents produced in the most remotes parts of the world, and to strengthen ties of knowledge with different cultures and peoples. The dematerialization and reproduction with hi-fi quality of cultural goods has altered our consumption habits. The gradual removal of the material support and the convenience of digital files made us consume culture in quantities and formats never imagined before. The advent of the digital put into question the traditional roles of artists and industries, and led us to a path of no return: the need to follow up the changes which have taken place and adapt to them. In the combat against practices like piracy, the legislation of many countries was hardened, and we saw the legal means dealing with the theme in radical ways. This study discusses this problem, taking as objects of analysis the brazilian and portuguese contexts. We discuss the laws that deal with copyright in both countries in order to focus on the relations between technology and law, and on the transformations produced by the Internet in these very delicate links. To this end, we also deal with the Net regulation, which is a theme closely linked to the aforementioned topics.
