| dc.description.abstract | O presente trabalho dedicar-se-á à analise crítico-reflexiva sobre o atual contexto jurídico da proteção que é dispensada aos animais pelo ordenamento Português, com especial incidência sobre a Constituição, o Código Civil e o Código Penal. Tendo em conta a cada vez maior preocupação da sociedade com o tema dos direitos e defesa dos animais, iremos dedicar uma parte deste trabalho à exposição das diferentes teorias que têm surgido em torno desta causa. Como forma de apontar o caminho para a mudança de paradigma de proteção animal em Portugal, iremos destinar, igualmente, um capítulo, à exposição do direito comparado vigente noutros países. Designadamente, sob a égide constitucional, serão debatidos os modelos de proteção animal direto e indireto, abordando-se, também, os ordenamentos onde estes se encontram vigentes, atualmente. No final deste subcapítulo terminaremos com a apresentação ao leitor de uma proposta de alteração constitucional, como forma de adequar a nossa lei magna a estes novos valores. Já no domínio civilista iremos abordar o regime em vigor, que ainda atribui, aos animais, a mera condição de coisa jurídica, assim como as mais relevantes teorias internacionais que têm surgido como forma de superação deste paradigma (animal como sujeito de direitos e animal tertium genus). No âmbito do Direito Penal, iremos aproveitar este trabalho para abordar as atuais normas que criminalizam os maus tratos e o abandono dos animais de companhia, apontando-lhe as suas virtudes e, sobretudo, os seus defeitos, como por exemplo, o facto de tais regras deixarem de fora, injustificadamente, a maioria dos animais em Portugal. Por fim, à semelhança das exposições dedicadas aos ramos constitucional e civilista, iremos, também aqui, propor a adição de novos artigos, assim como a alteração dos vigentes, como forma de tornar o direito em vigor mais forte, coerente e justo para com todos os animais. | pt_PT |
| dc.description.abstract | This work will be dedicated to the critical and reflective analysis of the current legal framework of the protection that is given to the animals by the Portuguese legal system, with particular emphasis on the Constitution, the Civil Code and the Penal Code. Taking into account the growing concern of society with the issue of rights and animal welfare, we will devote a part of this work to the exhibition of different theories that arise around this cause. In order to point the way for the change of animal protection paradigm in Portugal, we will dedicate a chapter to comparative law applicable in other countries. In particular, under the wardship of the Constitution, we will expose the direct and indirect animal protection models, without forgetting the jurisdictions where they are bumped into force, today. At the end of this subchapter, there will be a presentation, to the reader, of a proposed constitutional alteration, as a way to adjust our most important law with these new values. In the civilian domain, we will approach the current regime, which still grants, to the animals, the mere condition of legal thing, as well as the most relevant international theories that have emerged as a way to overcome this paradigm (animal as a subject of rights and animal tertium genus). Under criminal law, we will take this work to approach the current rules that criminalize abuse and abandon of pets (companion animals), pointing out its virtues, and, above all, its faults, since such rules, for example, leave out, unreasonably, most animals in Portugal. Finally, like the exhibition dedicated to the constitutional and civil law, we will here, too, propose the addition of new articles, as well as the alteration of the existing ones, in order to make the law stronger, consistent and fair to all animals. | en |
