O presente trabalho tem por objetivo analisar as afetações impostas pela patronagem à conformação racional da burocracia pública e demarcar como estas disfunções são condicionadas pelo ordenamento jurídico, seja pela criação de oportunidades disfuncionais, como pela imposição de limites legais e institucionais a estas práticas. Tratando-se de uma subespécie da disfunção burocrática clientelista, a distribuição de cargos públicos e posições administrativas sem intentos organizacionais e administrativos representa uma importante forma de desorganização da estrutura burocrática, da atividade administrativa e, consequentemente, das próprias políticas públicas de determinada organização política. A análise da realidade administrativa da burocracia brasileira e portuguesa, comparada com a própria estruturação do ordenamento jurídico apresentado em ambos os países, mostra, ao longo do estudo, como a recorrência de estratégias de patronagem é determinada, conjuntamente com a cultura político-administrativa, pelo desenho legal, procedimental e institucional destes ordenamentos jurídicos. São apresentados dados que demonstram as aberturas normativas e os incentivos à patronagem em ambos os Estados, revelando como a robustez institucional e a existência de procedimentos objetivos de recrutamento podem conformar instrumentos limitadores da irrestrita utilização de critérios dissociados da aptidão administrativa para a composição dos recursos humanos da Administração Pública de determinada ordem jurídica.
This paper aims to analyze the effects of patronage on the rational orientation of public bureaucracy and delineate the role of the legal order as a determinant of the presence of this bureaucratic dysfunction, either by creating patronage opportunities, or by imposing institutional and legal limits to these strategies. Being a subspecies of the clientelist dysfunction, the appointment of bureaucrats without organizational and administrative goals consists in a main form of disruption of the bureaucratic structure, the administrative activity and consequently of the public policies of a polity. The study of the Brazilian and Portuguese administrative context, compared with their own legal systems, shows throughout this paper how the recurrence of patronage strategies is determined or influenced, alongside the administrative and political culture, by the legal, procedural, and institutional design proposed. Data are shown to demonstrate the openings and incentives to the patronage actions in both these States, revealing how institutional strengthening and the creation of objective recruitment proceedings are instruments of limitation and control of the boundless use of political and personal criteria in the formation of the human resources of Public Administration.
