Após diferentes processos de transformação, as propostas para a configuração do Estado moderno têm contemplado uma atuação mais reguladora e subsidiária, que leva à ampliação da utilização de instrumentos de parcerias público-privadas para a realização de atividades de interesse público, como a prestação dos serviços educacionais. Reconhecida como um direito fundamental pelos tratados e acordos internacionais de direitos humanos, além de incorporada na maioria das Constituições nacionais, a efetivação do direito à educação requer um esforço conjunto entre os principais atores responsáveis por sua realização: o Estado, a sociedade e a família. A realização de parcerias entre os setores público e privado para a estruturação de sistemas educacionais mais plurais e para a efetivação plena do direito à educação pode ser considerada um fenômeno global. Enquanto vários países avançam nesse sentido, Portugal e, principalmente, Brasil sofrem impactos parciais dessas mudanças e têm enfrentado resistências políticas e ideológicas na implementação de parcerias com o setor privado para a provisão da educação. Enquanto Portugal demonstra avanços em alguns aspectos de seu sistema educacional, mas com inconstância quanto à garantia das liberdades e da equidade, o Brasil apresenta um quadro educacional ineficiente e injusto. Em ambas realidades, as parcerias público-privadas na educação devem ser melhor utilizadas e consideradas como importantes instrumentos de correção das distorções existentes nos respectivos sistemas educacionais.
After different transformation processes, the proposals for the configuration of the modern State have contemplated a more regulatory and subsidiary action, which leads to the expansion of the use of public-private partnership instruments to carry out activities of public interest, such as the provision of education services. Recognized as a fundamental right by international human rights treaties and agreements, and incorporated in most national constitutions, the realization of the right to education requires a joint effort among the main actors responsible for its realization: the State, society and the family. Partnerships between the public and private sectors for structuring more pluralistic educational systems and for the full realization of the right to education can be considered a global phenomenon. While several countries are advancing in this direction, Portugal and especially Brazil suffer from the impacts of such changes and have faced political and ideological resistance in the implementation of partnerships with the private sector for the provision of education. While Portugal demonstrates advances in some aspects of its educational system, but with inconstancy regarding the guarantee of freedoms and equity, Brazil presents an inefficient and unfair educational framework. In both realities, public-private partnerships in education should be better used and can be considered as important instruments for correcting existing distortions in their educational systems.
