O objetivo deste trabalho é compreender o papel da hermenêutica jurídica nos conflitos de demarcação de terras dos povos originários do Brasil e com isso investigar a natureza constitutiva da gramática comum do Direito, que se evidencia na atividade interpretativa. O estudo analisa o impacto da hermenêutica jurídica como intermediária em conflitos que envolvem diferentes formas simbólicas de representação do real, principalmente no contexto do encontro entre os mundos americano e europeu na Idade Moderna, e os seus efeitos contínuos na sociedade brasileira. Supõe-se que esses conflitos levem os hermeneutas a enfrentar problemas não jurídicos, superando os limites da técnica jurídica. A pesquisa busca descrever criticamente essa operação e identificar as respostas e limites da hermenêutica jurídica quando confrontada com questões que não podem ser resolvidas apenas pelo raciocínio lógico-dedutivo. A análise focará na tensão histórica para entender como a hermenêutica jurídica transforma o exótico em familiar e vice-versa, e como isso contribui para a definição da gramática comum do Direito. Serão examinados o impacto histórico e as implicações da colonização portuguesa nas Américas, com a busca de seu sentido, o papel dos povos originários nesse projeto, os conflitos daí decorrentes e as respostas dadas pela hermenêutica jurídica.
This study aims to understand the role of legal hermeneutics in land demarcation conflicts involving Brazil's indigenous peoples and to investigate the constitutive nature of the common grammar of Law, as evidenced in interpretative activities. The study examines the impact of legal hermeneutics as an intermediary in conflicts involving different symbolic forms of representing reality, particularly in the context of the encounter between the American and European worlds during the Modern Age, and its ongoing effects on Brazilian society. It is posited that such conflicts compel hermeneuts to confront non-legal issues, transcending the limits of legal techniques. This research seeks to critically describe this process and identify the responses and limitations of legal hermeneutics when faced with problems that cannot be resolved solely by logical-deductive reasoning. The analysis will focus on historical tensions to understand how legal hermeneutics transforms the exotic into the familiar and vice versa, and how this transformation contributes to defining the common grammar of Law. The historical impact and implications of Portuguese colonization in the Americas will be examined, including the search for its meaning, the role of indigenous peoples in this project, the resulting conflicts, and the responses provided by legal hermeneutics.
