O presente trabalho tem como escopo analisar o tratamento dado pelos ordenamentos jurídicos português e brasileiro à cedência temporária e ocasional de trabalhadores, face à importância destes institutos nos cenários econômico e social atuais e a expressiva utilização destes pelas empresas. Realiza uma análise na evolução legislativa no tocante a cada uma das modalidades e examina as normas que compõem estes regimes mediante a análise conceitual e da interpretação e aplicação a elas conferidas pela expressiva doutrina. O trabalho apresenta inicialmente conceitos e explanações básicas para uma melhor compreensão dos institutos centrais. O estudo aborda em um primeiro momento a cedência temporária de trabalhadores, com uma análise sobre as características essenciais do instituto e vínculos contratuais existentes entre os três sujeitos da relação. Analisa cada uma das legislações existentes sobre o tema e as consequências da relação laboral fragmentada (nos âmbitos dos poderes diretivo e disciplinar, remuneração e segurança e saúde do trabalhador) e aborda as consequências da inobservância das determinações legais. Após, ao discorrer sobre a cedência ocasional de trabalhadores, segue o mesmo padrão de pesquisa, com uma análise sobre as características essenciais, vínculos contratuais, legislações atinentes e as consequências fragmentação da relação laboral, bem como as consequências da inobservância das determinações legais. Ao realizar a análise dos institutos no ordenamento jurídico brasileiro, seguindo o padrão adotado ao longo de todo o estudo, aponta-se as características essenciais, vínculos entre as partes, hipóteses de cabimento e consequências da fragmentação e inobservâncias das normas legais.
The present paper aims to analyze the treatment given by the Portuguese and Brazilian legal systems to temporary and occasional employees assignment, given the importance of these institutes in the current economic and social scenarios and the expressive use of these by companies. It carries out an analysis of the legislative evolution concerning each of the modalities and examines the norms that compose these regimes through the conceptual analysis and the interpretation and application to them conferred by the expressive doctrine. The paper initially presents basic concepts and explanations for a better understanding of the central institutes. The paper initially approach the temporary assignment of workers, with an analysis of the essential characteristics of the institute and contractual bonds between the three subjects of the relationship. It analyzes each of the existing laws on the subject and the consequences of the fragmented employment relationship (within the scope of the directive and disciplinary powers, remuneration and safety and health of the worker) and addresses the consequences of non-observance with legal requirements. Afterwards, when discussing the occasional assignment of workers, it follows the same research pattern, with an analysis of the essential characteristics, contractual bonds, relevant legislation and the fragmentation consequences of the employment relationship, as well as the consequences of non-observance with legal determinations. When performing out the analysis of the institutes in the Brazilian legal system, following the pattern adopted over the study, the essential characteristics, bonds between the parties, hypotheses of fit and consequences of fragmentation and non-observance of legal norms are pointed out.
