No século XXI, século em que nos encontramos a viver, a proteção do ambiente impôs-se, a nível mundial, como um tema gerador de grande preocupação. Deste modo, sob a influência internacional, muitos países incluíram leis de proteção ambiental nas suas constituições. Um dos países aqui mencionados, Portugal, afigura-se como um estado de desenvolvimento económico e de sustentabilidade de recursos naturais e o outro - a China- afigura-se como uma “fábrica mundial”, uma vez que sempre deu relevo ao desenvolvimento económico-financeiro mas que, com o aumento da força nacional e a melhoria da qualidade de vida dos cidadãos, começou a conceder maior importância à proteção do meio ambiente. Assim, tem-se por objetivo ao longo desta exposição demonstrar como o ordenamento jurídico, português e chinês, estabelece a proteção
constitucional para o seu meio ambiente.
Este trabalho teve o seu início partindo da análise do enquadramento político-jurídico de ambos os países, seguido por uma breve análise das disposições constitucionais relacionadas com o meio ambiente, incluindo o seu desenvolvimento e características mais evidentes.
Com base nesse estudo, também se discutiu, sumariamente, aspectos derivados das disposições ambientais nas constituições dos dois países, como as semelhanças e diferenças nos princípios do direito ambiental no contexto constitucional e a expressão dos direitos fundamentais ambientais nas constituições de ambos os países.
Por fim, revelou-se inevitável abordar os mecanismos de mediação e resolução judicial, em matéria de proteção ambiental. Esse percurso foi feito por meio de uma análise sucinta das vias judiciais disponíveis para os cidadãos defenderem os seus interesses ambientais, com vista a discutir a direção do desenvolvimento da proteção ambiental em ambos os países.
In the 21st century, the era in which we are currently living, environmental protection has emerged globally as a major cause for concern. Consequently, under international influence, many countries have incorporated environmental protection laws into their constitutions. One such country, Portugal, stands out as a state focused on economic development and natural resource sustainability, while the other - China - is recognized as a "world factory," having historically prioritized economic and financial growth. However, with increasing national strength and improvements in quality of life, China has begun to place greater importance on environmental protection. Thus, the objective of this exposition is to demonstrate how the legal frameworks of both Portugal and China establish constitutional protection for their respective environments. This work began by analyzing the political and legal frameworks of both countries, followed by a brief examination of the constitutional provisions related to the environment, including their development and most prominent characteristics. Based on this study, aspects derived from environmental provisions in the constitutions of both countries were also discussed, such as similarities and differences in environmental law principles within the constitutional context, as well as the expression of fundamental environmental rights in both countries' constitutions. Finally, it became inevitable to address mechanisms of mediation and judicial resolution regarding environmental protection. This journey was undertaken through a concise analysis of the available judicial avenues for citizens to defend their environmental interests, with the aim of discussing the direction of environmental protection development in both countries.
