O presente trabalho busca estabelecer a identidade jurídica da Constituição brasileira de 1988 e o resgate de um projeto constitucional que sofre resistências durante todo o período de sua vigência. Para concretizar tais objetivos foram delimitados conceitos bases sobre constitucionalismo, contratualismo, contrato social, vontade geral, supremacia da Constituição, rigidez constitucional, poder constituinte, ideologia constitucionalmente adotada e constitucionalismo dirigente adequado à modernidade periférica. Partindo de uma perspectiva ao qual interpreta o constitucionalismo como movimento político caracterizador de nossa época, pretendeu-se chamar a atenção para a importância da vinculação política ao projeto constitucional e as dificuldades enfrentadas em uma sociedade de formação tardia e periférica como a brasileira.
The present study seeks to establish the legal identity of the 1988´s Brazilian Constitution and the rescue of a constitutional project that undergoes resistance during the period of its validity. To achieve these objectives, concepts based on constitutionalism, contractualism, social contract, general will, constitutional supremacy, constitutional rigidity, constitutional power, ideology that was constitutionally adopted and constitutionalism suitable to peripheral modernity were delimited. Starting from a perspective whose interprets constitutionalism as a political movement that characterizes our epoch, it was intended to call attention to the importance of a political bonding to the constitutional project and the difficulties faced in a late and peripheral formation society such as the Brazilian one.
