Um envolvimento (muito) débil : a comissão de trabalhadores em Portugal

Apesar de o direito dos trabalhadores criarem comissões de trabalhadores ao nível da empresa estar reconhecido na Constituição da República Portuguesa, a realidade é que tais comissões não só são pouco numerosas como o seu papel efetivo é muito modesto. A evolução do direito europeu não alterou este quadro. É certo que essa evolução contribuiu para aumentar as competências da comissão. Contudo, o facto de que a existência das mesmas não é imperativa seja qual for a dimensão da empresa, bem como o de não se achar legalmente previsto qualquer meio de financiamento para o desempenho de funções crescentemente complexas e exigentes, acarretam que a intervenção das comissões é, em grande medida, uma ilusão. Do ponto de vista histórico esta situação é o resultado da hostilidade, tanto dos sindicatos, como dos empregadores. As alterações recentes da lei laboral (Lei n.º 13/2023 de 3 de abril) não alteraram este paradigma.
In spite of the express recognition in the Portuguese Constitution of the right of the workers to create workers’ councils at the level of the enterprise, the reality is that workers’ councils in Portugal are relatively few and with a very modest role. The evolution of the European Law has not changed this reality. It is true that as a result of that evolution theoretically more and more functions are attributed primarily to workers’ councils. However the fact that their existence is not mandatory regardless of the dimension of the enterprise and that no means of financing are provided in the law for the fulfillment of increasingly complex and demanding functions has a result that their intervention is to a large extent illusory. Historically such an outcome was the result of the hostility both of the trade unions and of the employers. Recent changes in the Portuguese labour law have not really changed this paradigm.
