A Lei nº 9/2010 de 21 de Maio legalizou o casamento entre pessoas do mesmo sexo. Neste
trabalho discutem-se os princípios básicos da mediação familiar, os problemas inerentes à
“vida intima” de pessoas do mesmo sexo e o preconceito social existente para com elas.
Procurou-se averiguar a recetividade dos mediadores familiares do sistema público e
potenciais utentes homossexuais face à mediação familiar. Neste estudo responderam 39
mediadores familiares do SMF e 40 indivíduos com orientação homossexual.
Na recolha dos dados, foi enviado um questionário via email e, posteriormente realizaram-se
16 entrevistas telefónicas, de forma aleatória, entre os mediadores respondentes. Para a
população homossexual foi utilizado um questionário (online e em papel) na ILGA – Portugal
e no GRIP. O tratamento dos dados quantitativos realizou-se no programa do Microsoft Excel.
Os resultados mostram que, no sistema público nunca foi efetuada nenhuma mediação em
casais homossexuais, embora a maioria dos mediadores familiares não tenha qualquer
impedimento de o fazer. A maioria destes casais vive em união de facto e sabe o que é a
Mediação Familiar embora nunca tenha usado o serviço, mostrando-se recetivo à sua
utilização. Este trabalho pretende contribuir para a maior utilização do serviço de mediação
familiar por casais homossexuais.

In this Work we discuss the basic principles of family mediation, the problems inherent in "intimate life" of same-sex and social prejudice that exists toward these people. We sought to examine the receptivity or not family mediators of the public and potential homosexuals users face family mediation. In this study answered 39 family mediators of SMF and 40 individuals with homosexual orientation. To collect data for mediators, a questionnaire was sent via email and after these, there were 16 telephone interviews of randomly among respondents mediators. For the homosexual population was used a questionnaire (online and paper-based) on ILGA - Portugal and on GRIP. The quantitative data was done on Microsoft Excel program. The main results show that the system was never made public any mediation for same-sex couples, however most family mediators has no impediment to conduct mediations in samesex couples. Most gay couples are living in de facto union and that most know what is the Family Mediation although they have never used the service, but show up receptive to use it. It is hoped that this work is a contribution to a greater use of family mediation service by same-sex couples.
