O presente trabalho que se propõe apresentar situa- se entre os campos da liberdade do homem e o cumprimento de uma pena privativa de liberdade. Pois, a liberdade é uma das grandes questões da humanidade desde os primórdios aos dias atuais. Seu conceito é objeto de discussão em toda a história da filosofia e ganhou diversos significados ao longo dos anos. Nos dias atuais, a perda da liberdade é usada como ameaça para conter praticas violadoras de direitos e garantias sociais. Este trabalho tem como objetivo analisar, através de uma revisão bibliográfica de autores, nomeadamente brasileiros, do Séc. XIX, que escreveram sobre a liberdade humana numa época reveladora de grandes conquistas, perante revoluções importantes alteração política. Nesta perspetiva, analisaremos o crime como um fenômeno social complexo que tende a aumentar consoante o aumento dos problemas socias. Partindo dessa premissa, faz sentido gastar um tempo na tentativa de clarificar a liberdade do ser humano concionada às regras de uma sociedade pluralista, intolerante e materialista. Convém salientar que a abordagem que faremos aqui terá como escopo a reprodução de factos que alteraram o comportamento humano frente às mudanças no âmbito mundial. Em consequência de tais factos, levanta-se a discussão sobre a liberdade daqueles que, por afinidade ou por necessidade, sem querer justificar qualquer prática criminosa, cometeram crimes e foram retirados do convívio social. Nesta mesma abordagem, por ser relevante para conclusão do presente trabalho, sem intenção de restringir novos estudos, far-se-á necessário analisarmos sobre a situação carcerária do Brasil, um país enorme com problemas socias graves que favorecem a superlotação nas mais diversas prisões. Um problema atual e que poem em causa a própria finalidade da pena privativa de liberdade que deve ter como objetivo a ressocialização do detento. Há muitos anos que muitos países tentam resolver o problema do crescimento dos encarcerados, porém, é sabido que se trata de um problema social complexo, que requer uma ativa participação da sociedade como coadjuvante.
The present Thesis that we propose, is situated between the fields of human freedom and the execution of a custodial sentence. Freedom is one of the greatest questions of humanity from its roots to the present day. Its concept is subject of discussion throughout the history of philosophy and has gained several meanings over the years. Nowadays, the lack of freedom is used as a threat to curb practices that violate social rights and guarantees. The aim of this work is to analyze, through a bibliographic review of authors, namely Brazilians, of the XVIII century. These authors wrote about human freedom in an epoch that revealed great conquests, in the face of important revolutions, political change. From this perspective, we will analyze crime as a complex social phenomenon that tends to increase as social problems arise. Based on this premise, it makes sense to spend time trying to clarify the freedom of the human being bound by the rules of a pluralistic, intolerant and materialistic society. It should be noted that the approach we will make here will have as its scope the reproduction of facts that have altered human behavior in the face of changes in the world scope. As a result of these facts, the discussion arises about the freedom of those who, by affinity or necessity, without wanting to justify any criminal practice, have committed crimes and have been removed from social life. In this same approach, as it is relevant to the conclusion of the present work, without the intention of restricting new studies, it will be necessary to analyze the prison situation in Brazil, a huge country with serious social problems that favor overcrowding in the most diverse prisons. This is a current problem that calls into question the very purpose of the custodial sentence, which should aim at the rehabilitation of the detainee. For many years, many countries have been trying to solve the problem of the growth of incarcerated people, but it is known that this is a complex social problem, which requires the active participation of society as a supporting role.
