O estudo sobre a influência dos movimentos sociais no Direito Constitucional, notadamente no que diz respeito à cláusula de abertura dos Direitos Fundamentais, revela como a participação popular desempenha um papel crucial na ampliação e concretização dos direitos. A sociedade civil organizada, ao expressar demandas coletivas, atua como agente transformador da realidade política, jurídica e social, reivindicando reconhecimento, inclusão e a efetivação de garantias que atendam às necessidades da coletividade. A presente pesquisa visa apresentar a Constituição como um instrumento normativo e dinâmico que permite a incorporação de novos direitos no ordenamento jurídico por meio de análise interpretativa decorrente do regime e dos princípios por ela adotados, além de demonstrar a relevância da participação popular para a construção e fortalecimento do Estado Democrático de Direito.
The study of the influence of social movements on Constitutional Law, notably about the opening clause of Fundamental Rights, reveals how popular participation plays a crucial role in expanding and realizing rights. Organized civil society, when expressing collective demands, acts as an agent that transforms political, legal and social reality, demanding recognition, inclusion and the implementation of guarantees that meet the needs of the community. This research aims to present the Constitution as a normative and dynamic instrument that allows the incorporation of new rights into the legal system through interpretative analysis arising from the regime and principles adopted by it, in addition to demonstrating the relevance of popular participation for the construction and strengthening the Democratic Rule of Law.
