A presente dissertação tem como objetivo investigar a justiça consensual penal no ordenamento jurídico brasileiro, especificamente no que se refere à conjugação de dois critérios aparentemente opostos na estruturação do processo penal: a busca de uma maior eficiência e a relevância das garantias fundamentais do processo. Desse modo, o estudo partirá da análise do modelo consensual de justiça penal, examinando, em seguida, a plea bargaining do sistema norte-americano e seus similares na Alemanha, Itália e Portugal. Nesse contexto, será traçado o perfil da justiça consensual na Lei 9.099/1995 e de seus institutos representativos, apontando algumas críticas referentes ao tema. Por último, serão especificados alguns problemas práticos da justiça consensual penal e também as medidas complementares que poderão favorecer o melhor funcionamento dos Juizados Especiais Criminais.
The current paper aims to investigate the criminal justice consensus in Brazilian law, specifically regarding the combination of two seemingly opposite criteria in structuring the criminal proceedings: the search for greater efficiency and the relevance of the fundamental guarantees of the process. Thus, the study will start from the analysis of the consensus model of criminal justice, examining, then the plea bargaining of the US system and their corresponding in Germany, Italy and Portugal. In this context, it will be drawn the profile of consensual justice in Law 9.099/1995 and their representative institutions, pointing some criticism on the subject. Finally, it will be specified some practical problems of criminal justice consensus and also additional measures that could help to improve the functioning of the Special Criminal Courts.
