Na presente investigação propomos a reflexão sobre o recurso extraordinário de revisão de sentenças proferidas em ações de investigação de paternidade. E para compreendermos os contornos deste instituto, será necessário partir, em primeiro lugar, da análise da ação declarativa de investigação de paternidade e, posteriormente, sobre os efeitos da respetiva sentença. Iremos assim refletir sobre a instrução das ações de investigação de paternidade e sobre a importância da produção de prova direta, mediante a submissão das partes a exames científicos, nomeadamente, a exames de ADN. Não alcançada a decisão materialmente justa em primeira instância quanto à paternidade biológica, a nossa reflexão será sobre a possibilidade de impugnação da decisão judicial através do recurso extraordinário de revisão, quando esta já se encontre coberta pelo caso julgado material. O recurso extraordinário de revisão visa um verdadeiro compromisso, entre o princípio da justiça material, perante casos em que a decisão judicial possa ser ilegal ou injusta, e o princípio da estabilidade e segurança jurídica. Por ser o recurso de revisão um meio extraordinário de impugnação de decisões judiciais a questão que se colocará durante a nossa investigação será o da suficiência dos seus fundamentos perante decisões judiciais onde a paternidade jurídica não corresponda à paternidade biológica.
Pelo que a presente investigação tem por objetivo a problematização deste recurso em ações de investigação de paternidade, atendendo às decisões proferidas pelos nossos tribunais e ao posicionamento da nossa doutrina. Procura-se saber se a demonstração da paternidade biológica poderá ser alcançada no recurso de revisão e, se pode este, representar uma derradeira oportunidade ao princípio da verdade biológica.
In this research we propose a reflection on the extraordinary appeal for review of judgments handed down in paternity investigation actions. In order to understand the contours of this institute, it will be necessary to start by analyzing the declaratory action of paternity investigation and, subsequently, the effects of the respective sentence. We will then reflect on the investigation of paternity actions and the importance of producing direct evidence by submitting the parties to scientific tests, namely DNA tests. If a materially fair decision on biological paternity is not reached at first instance, we will reflect on the possibility of challenging the judicial decision through an extraordinary appeal for review, when it is already covered by res judicata. The extraordinary appeal for review aims at a real compromise between the principle of material justice, in cases where the judicial decision may be illegal or unjust, and the principle of stability and legal certainty. As the appeal for review is an extraordinary means of challenging judicial decisions, the question that will arise during our investigation will be the sufficiency of its grounds in the face of judicial decisions where legal paternity does not correspond to biological paternity. The aim of this research is therefore to problematize this appeal in paternity investigation actions, taking into account the decisions handed down by our courts and the position of our doctrine. The aim is to find out whether the demonstration of biological paternity can be achieved in an appeal for review and whether this can represent a final opportunity for the principle of biological truth.
