Investigação acerca da existência de um direito fundamental à água, a nível internacional, europeu e nacional. Na positiva, análise da natureza desse direito fundamental enquanto direito, liberdade e garantia ou direito económico, social e cultural análogo a um direito, liberdade e garantia. Seguidamente, perspetivas em que este direito tem vindo a ser reconhecido, nomeadamente como subdireito do direito à vida, do direito à saúde, do direito ao ambiente (para quem, como nós, conceda a sua existência) ou do direito à alimentação. Perante conclusões da análise, traçar do regime de proteção deste direito, ao abrigo do qual um cidadão ou todos os cidadãos poderão invocar o “seu” direito à água, como bem essencial à vida que é, e que será missão do Estado proteger e efetivar, através de entidades criadas para esse fim. O saneamento está indissociavelmente ligado ao direito à água, pelo que constitui um serviço que o Estado terá de providenciar, na prossecução daquela missão. O papel das organizações ambientalistas será evidenciado, assim como o serão as questões relacionadas com a indústria alimentícia e com a comercialização de água engarrafada. Breve incursão pelos novos instrumentos de mercado de biodiversidade, contrariando a desconfiança que assumimos ter, à partida, por esse instituto. Dissertation about the existence of a right to water as an international, european and national fundamental right. In the face of the existence of such a right, analyses on the nature of that fundamental right as a constitutional right, freedom and guarantee or as an economical, social and cultural right analogue to a right, freedom and guarantee. Then, the various perspectives on the recognition of this right, namely as a sub right to the right to life, to the right to health, right to the environment (for those who conceive its existence) or to the right to food. Before the conclusions of this study, we will be able to draw the regulatory framework on this right, in which name every single citizen can invoke their right to water as it is a vital right that has to be protected and guaranteed by the State, through public entities created specially for that end. Sanitation is inextricably linked to right to water, by which is a service that State is obligated to provide in its mission to guarantee the right to water. The important role of the environmental organizations will be evidenced, as it will be the matters related to the food industry and bottled water industry. Brief incursion into the new biodiversity market instruments, militating against our mistrust towards that institute. Actuate portuguese legal remedy “intimação para protecção de direitos, liberdades e garantias” (literally meaning: subpoena to protect rights, freedoms and guarantees”) to defend the right to water.
