| dc.description.abstract | Este trabalho visa dar nota do desenvolvimento e ponto de situação das questões que a circulação de trabalhadores entre Estados coloca quanto à continuidade dos seus direitos em matéria de protecção social. Em primeiro lugar, situa-se no tempo e no espaço a legitimidade e essencialidade das garantias sociais dos trabalhadores migrantes face às soluções técnicas e jurídicas disponíveis. De seguida, refere-se o papel das organizações internacionais na elaboração de princípios e regras eficazes em matéria de protecção social internacional e sua influência na celebração das convenções bilaterais entre Estados e no modelo tipo mais bem conseguido: a coordenação dos regimes de segurança social dos Estados-membros no âmbito da União Europeia necessária para garantir a livre circulação de trabalhadores. Finalmente, faz-se uma breve referência ao contributo da jurisprudência do Tribunal de Justiça da União Europeia para o desenvolvimento da técnica da coordenação. | pt_PT |
| dc.description.abstract | This paper aims to give note of the development and state of the situation of the issues that the movement of workers between states raises regarding the continuity of their rights in the field of social protection. Firstly, the legitimacy and essentiality of the social guarantees of migrant workers in relation to the technical and legal solutions available is situated in time and space. The following is the role of international organisations in developing effective principles and rules on international social protection and their influence on the conclusion of bilateral conventions between States and on the best-achieved type model: the coordination of the social security schemes of the Member States within the European Union necessary to ensure the free movement of workers. Finally, a brief reference is made to the contribution of the case-law of the Court of Justice of the European Union to the development of the coordination technique. | pt_PT |
