A dominialidade dos bens afectos à produção de energia hidroeléctrica

Resumo(s)
A produção de energia eléctrica através do aproveitamento da energia hidráulica da água, tem sido uma prática desenvolvida ao longo dos últimos anos em Portugal, em razão de se querer alcançar as metas de emissão de gases com efeito de estufa estabelecidas, no plano internacional e no plano europeu. A par deste desenvolvimento, a actividade de produção de energia hidroeléctrica para fins de utilidade pública foi sendo liberalizada e actualmente, é uma actividade privada, cabendo ao Estado a função de garantir a satisfação das necessidades colectivas. A produção de energia hidroeléctrica está associada a grandes empreendimentos do domínio público – as barragens e ao aproveitamento dos recursos hídricos do domínio público, os quais constituem bens do domínio público hídrico, sendo-lhes aplicável um regime específico de domínio público. Procuramos então, na nossa dissertação, analisar os aspectos que consideramos mais relevantes do regime do domínio público subjacente aos bens que estão afectos à produção de energia hidroeléctrica.
The production of electricity by the utilization of water energy, has been a practice developed over the last years in Portugal, due to achieve the greenhouse gas emission targets established, on International and European levels. Alongside this development, the production of hydroelectric power activity for public utility purposes, has been liberalized and nowadays it is a private activity, and the State has the task of ensuring the satisfaction of collective needs. The production of hydroelectric power is associated to public domain big enterprises – a dam and to the utilization of public domain hydric resources, which constitute public water domain assets and a specific public domain regime applies to them. So, in our dissertation, we seek to analyze the aspects that we consider to be the most relevant of the underlying public domain of the assets that are used for hydroelectric power generation.
