Por essa razão, analisa-se a legitimidade democrática da judicial review e as suas implicações na separação de poderes. Diante da complexidade das sociedades contemporâneas, questiona-se se a separação de poderes como é estruturada atualmente é suficiente para a complexa dinâmica entre os Poderes. O estudo centra-se em analisar a atividade da jurisdição constitucional nos casos particulares da Alemanha, do Brasil e dos Estados Unidos, relacionando como as suas estruturas e as suas decisões refletem na dinâmica política e institucional de cada país. O trabalho utiliza-se das Teorias dos Diálogos Institucionais para pensar em uma reconfiguração institucional que harmonize a revisão judicial com princípios democráticos. Investiga-se, assim, as teorias dialógicas em seus conceitos e críticas, com o intuito de equilibrar os Poderes e repensar a separação de poderes de forma colaborativa, sem comprometer a legitimidade da jurisdição constitucional. Uma relação dialógica e cooperativa entre os Poderes é defendida na interpretação e implementação da Constituição, promovendo uma maior colaboração entre os poderes em processos deliberativos que visam alcançar uma decisão ideal e duradoura.The investigation evaluates the underlying principles of the global expansion of judicial review, thereby enabling the Courts to exercise their influence on various social, political, institutional, and economic issues. Hence, an analysis is conducted on the democratic legitimacy of judicial review and its implications for the separation of powers. Given the complexity of contemporary societies, the question arises whether the separation of powers as currently structured is sufficient for the complex dynamics between the Powers. The study focuses on analyzing the activity of judicial review in the particular cases of Germany, Brazil and the United States, relating how their structures and decisions reflect on the political and institutional dynamics of each country. The work uses Institutional Dialogue Theories to consider an institutional reconfiguration that would harmonize judicial review with democratic principles. Dialogical theories are therefore investigated in their concepts and criticisms with the aim of balancing the Powers and rethinking the separation of powers in a collaborative way without compromising the legitimacy of judicial review.
