Essa forma de poluição é ocasionada, principalmente, pelos resíduos plásticos que são gerados pelas atividades antropogênicas, sendo uma consequência do atual modelo de produção e consumo adotado pela sociedade moderna. A proliferação de plásticos nas mais diversas esferas da atividade humana e o aumento crescente da sua utilização, estão diretamente associados ao fenômeno da poluição marinha por plásticos. Nas últimas décadas, tem se verificado que uma quantidade cada vez maior desse material, dos mais variados tamanhos, chega até os oceanos. Uma vez no ambiente marinho, os plásticos sofrem os efeitos da degradação química e acabam fragmentados em microplásticos. Por serem leves e persistentes, encontram-se a flutuar por todos os oceanos do globo, seja na superfície, na coluna de água ou depositados no leito marinho, além de, também, ser verificada a sua presença nas praias. Os detritos plásticos causam impactos ambientais, econômicos, sociais e à saúde humana. O objetivo do presente estudo é analisar a dimensão do problema apresentado, quais as suas consequências para o ambiente marinho e como o direito internacional regula a questão. Para tanto, em um primeiro momento, será necessário compreender o que é poluição marinha e quais são as suas fontes. Para, após, fazer uma análise da poluição marinha por plásticos, buscando entender a sua origem, como os detritos plásticos chegam aos oceanos e quais as suas consequências para o ambiente marinho. Por fim, será verificado qual o papel do direito internacional, em especial do direito do mar e do direito internacional do ambiente, no combate e prevenção desse problema, também será visto o papel das organizações internacionais e atores privados, bem como, da soft law perante o tema e como o sistema internacional regulamenta a poluição do ambiente marinho por plásticos.The pollution of marine environment caused by plastics is a reality which is imposed on the international community. This form of pollution is mainly caused by plastic debris which are generated by anthropogenic activities, as a consequence of today’s production and consumption models adopted by modern society. The proliferation of plastic in a wide range of human activities and the continuous raise of its use are directly associated with the phenomenon of marine pollution by plastic. In the last decades, it has been observed that an increasing amount of this material, of the most varied sizes, gets to the oceans. Once in the marine environment, plastic materials suffer the effects of chemical degradation and end up being fragmented in microplastics. Because they are light and persistent, they are found floating in all oceans all over the world, either on the surface, on the water column or deposited in the seabed, besides having their presence detected on shores. Plastic debris cause environmental, social and economic impact, and it also impacts on the human health. The aim of the present study is to analyse the dimension of the issue presented, what its consequences to the marine environment are, and how international law regulates this issue. Therefore, firstly it will be necessary to understand what marine pollution is and what its sources are. Secondly, it will be necessary to analyse marine pollution by plastic materials, trying to understand its origins, how plastic debris get to the oceans, and what their consequences for the marine environment are then. The role of international Law will be verified, especially the Maritime Law and International Environmental Law in the combat and prevention of this issue.
