A internacionalização dos direitos, a necessidade de transformação do paradigma jurídico e a abertura ao diálogo cosmopolita são temáticas tratadas para averiguar mecanismos capazes de assegurar a dignidade humana em todos os tempos, lugares e modos. Em primeiro momento retrata-se os impactos da globalização no Estado Direito, que atravessa o pressuposto da soberania para enfim encarar os direitos fundamentais dos indivíduos em aspecto de ordem transnacional, como verdadeira evolução dos conceitos referentes aos direitos humanos. A seguir, cumpriu delinear o modelo atual de proteção internacional desses direitos humanos, que não se restringe a regimento de esfera global, mas conta com os sistemas regionais europeu, americano e africano, destacando suas especificidades. O exame desses sistemas regionais permitirá a identificação das convergências e divergências entre eles, bem como desenvolver os pontos fortes de cada um deles, a fim de compreender como o êxito de cada sistema pode contribuir com os demais, de forma que as experiências bem-sucedidas de cada abordagem possam servir reciprocamente, a afiançar mais eficácia e credibilidade a todos os sistemas regionais. Conclui analisando perspectivas doutrinárias com potencial de auxiliar na expansão da aplicação dos direitos humanos pelos sistemas regionais e global de proteção, como um corolário do evidenciado no decorrer da tese. Tudo isso para que se faça entender de uma forma mais coesa a problemática sugerida, trazendo maior perspectiva de eficácia à dignidade humana no espaço transnacional.The present research intends to contribute to the theme of fundamental human rights, especially in the external sphere, regarding the effectiveness of regional protection systems. The internationalization of rights, the need to transform the legal paradigm and the openness to cosmopolitan dialogue are themes addressed to ascertain mechanisms capable of ensuring human dignity in all times, places and ways. First, the impacts of globalization on the Rule of Law are portrayed, which crosses the assumption of sovereignty to finally face the fundamental rights of individuals in an aspect of a transnational order,as a true evolution of the concepts related to human rights. Next, it was necessary to outline the current model of international protection of these human rights, which is not restricted to the global sphere, but it relies on the European, American, and African regional systems, highlighting their specificities. The examination of these regional systems will allow the identification of convergences and divergences between them, as well as the development of the strengths of each of them,in order to understand how the success of each system can contribute to the others, so that the successful experiences of each approach can reciprocally serve each other, to ensure more effectiveness and credibility to all regional systems. It concludes by analyzing doctrinal perspectives that have the potential to help expand the application of human rights by regional and global protection systems, as a corollary of what was shown in the course of the research.
