A presente investigação visa refletir sobre a possibilidade de uma criança que não recebeu dos seus pais – ou de um deles - os cuidados afetivos essenciais ao seu desenvolvimento, e que viu o vínculo afetivo com os seus pais ser quebrado (ou nem sequer criado), poderá ser compensada através do instituto da responsabilidade civil pelos danos que sofreu. Analisando o conteúdo das responsabilidades parentais e o seu enquadramento jurídico, foi densificado o papel do afeto no âmbito das relações de filiação, por forma a compreender, por um lado, a sua importância e, por outro, as consequências que a omissão deste cuidado afetivo tem na vida das crianças. Assim, foram verificados os pressupostos da responsabilidade civil, por forma a concluir se o incumprimento do dever de educação, e a consequente violação do direito ao desenvolvimento da personalidade das crianças, permite a compensação destas através da aplicação do instituto da responsabilidade civil.Family and Child's Law has evolved towards recognizing the importance of affection in family relationships, with significant repercussions in the Portuguese legal system. This research aims to reflect on whether a child who has not received the necessary affective care essential to their development from both their parents - or one of them - and who has seen the affective bond with said parents broken (or not even created), can be compensated through the institute of civil liability for the damage they have suffered. Analysing the content of parental responsibilities and their legal framework, the role of affection in the context of filiation relationships was addressed to understand, on the one hand, its importance and, on the other, the consequences that the omission of this affective care may have on children's lives.
