Esta delimitação passará pelo enquadramento no regime direito sancionatório público dos intercâmbios direitos ou indiretos de informação, da partilha unilateral de informação, pública ou privada, tendo como pano de fundo o conflito entre economistas e juristas pela liderança na evolução do direito da concorrência e o sistema jurídico no qual as referidas disposições legais estão integradas. Por fim, importará, ainda, determinar se o conceito de práticas concertadas está preparado para desafios futuros, no que concerne o alargamento da difusão de informação, em particular no contexto da economia digital.This work will undertake a legal delimitation of the concept of concerted practices, frequently used in the enforcement of Article 101 of TFEU and of Article 9 of the Portuguese Competition Act, in alternative or together with the concept of agreement, considering the need to ensure the coherence in the interpretation of these provisions. This delimitation will include the analysis of direct or indirect exchanges of information, of unilateral sharing of information, whether public or private, having as background the conflict for the control of the drivers’ seat in the evolution of the competition law, and the need to articulate the interpretation of the concept with the legal system in which the referred provisions are integrated.
