É analisado o vínculo jurídico do gestor público, o seu recorte e natureza jurídica, tendo em consideração a evolução do papel do Estado, o reposicionamento do Direito Administrativo e o cruzamento entre o direito público e o direito privado. É identificado o eixo de vinculação do gestor público, pela análise exaustiva dos princípios e normas aplicáveis, de direito público e direito privado. O trabalho debruça-se ainda sobre a relação do Estado e do gestor público, ao nível da orientação, autonomia e controlo do gestor, dentro do quadro jurídico-constitucional.This thesis analyses the legal status of the public manager in portuguese law and its evolution over the last 50 years. The legal relationship of the public manager is examined, as well as its scope and legal nature, taking into account the evolution of the role of the state, the repositioning of administrative law and the intersection between public and private law. The obligations and duties under which the public manager is bound are identified, through an exhaustive analysis of the applicable principles and rules of public and private law.
