A pesquisa analisa a jurisprudência do Tribunal para verificar se este adota uma abordagem comprometida com a defesa dos direitos humanos, especialmente no que diz respeito à proibição de expulsões coletivas e ao princípio de non refoulement, à luz da tensão existente entre tais garantias e a prerrogativa estatal de controlar suas fronteiras.The present study examines the European Court of Human Rights' understanding of summary returns (pushbacks) of foreign nationals at land borders — a practice that involves forcibly removing foreign nationals without assessing their individual circumstances and, at times, outside the framework of any formal procedure.
